Directions:

Heading from London on the A21 you will turn off to Bodiam opposite the White Horse pub, after passing through a village called Hurst Green. Carry on straight over the cross roads by the Curlew Pub and down the hill and you will enter Bodiam with the Castle on your left and the Castle Inn on your right. Continue over the hump back bridge and the level crossing, and Quarry Farm is the next farm entrance on the right. Turn into the drive and follow the sign posts. If entering Bodiam from the opposite direction then Quarry Farm is the last turning on the left before the level crossing and after Dagg Lane -the junction to Ewhurst Green - which will be on your right. Bodiam is very well sign posted because of the Castle so hopefully it shouldn’t be too hard to find!

Information for sellers

Charges: £1.00 lotting fee per lot entered and 15% commission on the hammer price.

There is no unsold fee but vendors are required to collect their unsold items by 5pm on the Friday following the auction, or they will be disposed of or given to charity. This is because the premises is rented for the period of the sale only and there are no storage facilities available after this time.

Vendors will be paid by cheque within one month of the sale and sooner if funds are cleared.

TERMS & CONDITIONS OF CONSIGNMENT FOR VENDORS

1. Philippa H Deeley Ltd acts solely as auctioneers, valuers, consultants and agents and is called ‘the Company’
2. The representative of the Company conducting the auction is called ‘the auctioneer’
3. The auctioneer shall be solely responsible for the regulation and control of the bidding and in particular has absolute discretion to divide any lot, to combine any two or more lots, to withdraw any lots from sale, to refuse bids or cancel the sale without giving any reason or previous notice. The auctioneers may bid on behalf of the vendor for all lots subject to reserve. All formal information concerning any lot is subject to modification by announcement by the auctioneer prior to any bid being accepted for the lot.
4. The highest bidder for a lot shall be the buyer. All lots are offered for sale without reserve and as such will be sold to for the highest amount bid, unless otherwise agreed between the vendor and the auctioneer. The reserve shall be the minimum hammer price at which the lot may be sold except that a lot may be sold, during or after the sale, below the reserve price provided the vendor receives a sum equal to the net proceeds of a supposed sale of the lot at the reserve price.
5. While the company will strive to ensure the accuracy of the description of any lot in a catalogue or of the written or oral opinion in a condition report the Company does not accept responsibility or imply any warranty for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quantity of any lot.
6. The copyright of the text, photographs and illustrations contained in catalogues and other publicity material shall vest in the Company. Where the vendor provides the text, photographs and illustrations for publication the vendor warrants that use is authorised by the copyright owner and indemnifies the Company against claims and costs arising from wrongful use.
7. All goods held in the Company’s custody before and during the auction will be covered against the risk of fire, burglary, water damage and accidental damage except for damage to picture frames and glass or for the damage caused by woodworm or changes in atmospheric conditions. The value of the goods concerned is determined by their reserve or bottom estimate.
8. Withdrawn and unsold lots will be insured up to 5pm four days after the auction, after which the property becomes the responsibility of the vendor, unless an arrangement has been made with the auctioneer prior to this date.
9. The sale of soft furnishings is strictly regulated by statue law in the interests of fire safety. Goods found to infringe safety regulations will not be offered for sale and must be removed. The Company reserves the right to dispose of unsafe goods as refuse, at the vendor’s expense.
10. The vendor authorises the Company to transfer any or all of the goods listed herein to another auction house or sale venue in the UK or elsewhere for sale or exhibition.
11. The vendor acknowledges that the Company’s charges (Electrical charges, lotting fee per lot entered and commission on the hammer price) as set out herein shall be deducted by the Company from the hammer price of a lot before accounting to the vendor for the net proceeds of the sale.. The vendor acknowledges that the charge for a lot withdrawn from the sale is 10% of the reserve price or lower estimate.
12. The buyer shall pay to the Company a premium of 12% of the hammer price and the vendor acknowledges the Company’s right to retain this premium.
13. The Company shall account to the vendor for the net proceeds of sale by transfer to the bank or building society account detailed herein or by means of a crossed account payee sterling cheque drawn in favour of the vendor. Payment will be made within 28 working days after the sale, provided settlement has been received in full by the buyer. The vendor authorises the Company at the cost of the vendor to take whatever reasonable action is deemed necessary to obtain settlement from the buyer or to cancel the sale and refund any monies paid on account to the buyer. The Company disclaims responsibility for default by either the vendor or buyer because it acts as auctioneer and agent only and does not account to the vendor before payment is received from the buyer.
14. If within three months after the sale the buyer of any lot serves formal notice alleging that the lot is a deliberate forgery and returns the lot to the Company in the same condition at the time of the sale and produces evidence acceptable to the Company that the lot is a deliberate forgery then the sale of the lot will be rescinded. The Company will reimburse the buyer for the amount paid for the lot within seven days of the vendor refunding to the Company the net proceeds of sale.
15. Any dispute between vendor and buyer relating to goods consigned to the Company for sale, including recession, which cannot be settled by agreement shall be settled by an independent arbitrator. The vendor and buyer shall be bound by the decision of the arbitrator including the incidence of costs.
16. The vendor indemnifies the Company, the auctioneer, it’s employees and agents against claims arising from the sale and storage of the vendor’s goods to include claims in respect of any of the vendor’s warranties herein. The Company shall hold these indemnities for the benefit and on trust for it’s employees and agents.
17. Every person on premises used by the Company for the conduct of it’s business shall be deemed to be there at their own risk and shall have no claim against the Company in respect of accident, injury, damage or loss however caused.
18. All sales conducted by the Company are subject to English law and any litigation will be subject to the non-exclusive jurisdiction of the English Courts.

Information for Buyers

Buyers Premium is 15% of the hammer price. Payment by cash or cheque with guarantee card only – WE ARE NOT ABLE TO TAKE ANY ELECTRONIC METHOD OF PAYMENT SUCH AS CREDIT OR DEBIT CARDS.

Buyers are required to register to bid and will be given a paddle number

TERMS AND CONDITIONS FOR BUYERS

19. Inspection
Buyers and prospective Buyers are deemed to have satisfied themselves before bidding by inspection or otherwise as to (but not limited to) the physical condition (including defects) of the Lot and its description in the Catalogue.
20. The Buyer
20.1 Any dispute as to who is the Buyer of any Lot shall be settled by Philippa Deeley Ltd.
21.2 Every bidder at an auction run by Philippa H Deeley Ltd shall be deemed to act as principal unless prior to the start of the auction Philippa Deeley Ltd has been given a written acknowledgment that a bidder is acting as agent for a named principal
21. Buyer’s Premium
Where a Buyer’s Premium is levied it shall be 12% inclusive of the Hammer Price. The Buyer also acknowledges that Philippa H Deeley Ltd may receive commission from the Seller.
22. VAT
VAT is only payable on lots sold on behalf of VAT registered companies or individuals. This will be made clear both in the catalogue and by the auctioneer when the item is due to be sold. Philippa H Deeley Ltd is not VAT registered and therefore VAT is not added to the buyer’s premium or the seller’s commission.
23. Commission Bids
23.1 - Prospective Buyers are advised to attend in person auctions runs by Philippa H Deeley Ltd. However Philippa H Deeley will if so instructed execute written bids up to a specified limit from prospective Buyers sent by post or facsimile transmission to Philippa H Deeley Ltd in advance of an auction or (at Philippa H Deeley Ltd’s discretion) bids by telephone made by or on behalf of prospective Buyers before the auction. The Buyer shall deliver any instructions regarding commission bids whether delivered by post, facsimile transmission, telephone or in person to the appropriate employee of Philippa H Deeley Ltd, being the Auctioneer or an employee authorised to accept such instructions. Neither Philippa H Deeley Ltd nor its employees or agents will be liable for any neglect, default or failure to act in connection with any commission bids.
23.2 - In the event that Philippa H Deeley Ltd has received commission bids on a Lot for identical amounts and at auction those commission bids are the highest bids for the Lot, and to Philippa H Deeley Ltd’s ultimate discretion it shall be sold to the person whose commission bid was received first.
24 - Title and Risk
24.1 - Upon the acceptance of a bid (indicated by the fall of the hammer) by the Auctioneer
24.2.1 - a contract of sale for the Lot in question is completed between the Buyer to which Philippa H Deeley Ltd is not a party and will not be liable for any breach thereof by either the Seller of the Buyer.
24.2.2 - the Lot will be at the sole risk of the Buyer who shall forthwith show his bidding registration card or give his full name and permanent address and if called upon to do so by the Auctioneer shall forthwith pay to Philippa H Deeley Ltd such proportion of the Purchase Price as the Auctioneer may require. Failure by the Buyer to do so may (at the Auctioneer’s sole discretion) lead to the Lot being put up again and re-sold.
24.3 - Legal title to the Lot will not pass to the Buyer until the Purchase Price has been paid (and all monies cleared). Philippa H Deeley Ltd shall be entitled to a lien on any Lot sold until the Purchase Price has been paid.
25 - Payment
25.1 - A prospective Buyer must prior to an auction register to bid and must then give Philippa H Deeley Ltd their full name and permanent address and if requested by Philipppa H Deeley Ltd, banking or other suitable references.
25.2 - the Purchase Price must be paid to Philippa H Deeley Ltd not later than 48 hours following the auction.
25.3 - Full payment for all Lots must be made to Philippa H Deeley Ltd by means of banker’s draft or cash. Where the Buyer wishes to pay by cheque, the Lot will not be released to the Buyer until the cheque has been cleared unless arrangements have been made with Philippa H Deeley Ltd prior to the date of the auction.
25.4 - Any payments by a Buyer to Philippa H Deeley Ltd may be applied by Philippa H Deeley Ltd towards or set off against any sums owing from that Buyer to Philippa H Deeley Ltd on any account whatever regardless of any directions of the Buyer or his agents, whether express or implied.
26 - Removal of purchased Lots
26.1 - No Lot may be removed by the Buyer until the Purchase Price has been paid in full and the monies cleared.
26.2 – The buyer must remove all of their purchases or arrange the collection thereof at their expense for no later than 5pm four days after the sale.
27 - Responsibility for purchased Lots
27.1 - As the risk in respect of a Lot will pass to the Buyer from the fall of the hammer, the Buyer will be responsible for any loss or damage to the Lot from that time.
27.2 - the Buyer of a Lot being a "motor vehicle" is responsible for complying with the provisions of the Road Traffic Act 1988 and all relevant regulations made there under (including the Motor Vehicles Construction and Use Regulations 1986) and statutory modifications thereof and for ensuring that any necessary test certificate is in force.
27.3 - the Buyer shall be solely responsible for obtaining any export licence or any other certificate or authority (including but not limited to a firearm certificate) required in connection with a Lot. Philippa H Deeley Ltd will not deliver Lots (being firearms) to Buyers without production of evidence of compliance with all UK firearm regulations.
27.4 - the Purchaser of any Lot containing Dangerous Substances agrees to comply with all Environmental Laws and the terms and conditions of all environmental licences and approvals required by Environmental Law, which are applicable to Dangerous Substances.
28 - Non-Payment or failure to collect
If a Lot is not paid for in full and removed in accordance with Conditions 7 and 8, Philippa H Deeley Ltd as agents for the Seller shall without further notice to the Buyer at its absolute discretion be entitled to exercise one or more of the following remedies (without prejudice to any other rights it may have):-
28.1 - issue legal proceedings against the Buyer for damages for breach of contract;
28.2 - rescind the sale of the Lot and re-sell the Lot by auction, private treaty or any other means;
28.3 - charge the Buyer all the charges and expenses of the re-sale (including but not limited to) any commissions for the rescinded sale which remain unpaid and the deficiency (if any) between the Hammer Price of the resale and the Hammer Price of the rescinded sale;
28.4 - remove, store and insure the Lot at the expense of the Buyer;
28.5 - charge interest on the Purchase Price at a rate not exceeding 4% per month to the extent that it remains unpaid for more than 5 working days after the date of the auction;
28.6 - retain any Lot knocked down to the Buyer at the same time or any other auction until payment of a Purchase Price by the Buyer;
28.7 - exercise a lien on any other property of the Buyer in Philippa H Deeley Ltd’s possession for any purpose;
28.8 rescind the sale of that Lot or any other Lot knocked down to the Buyer at the same or any other auction;
28.9 reject or ignore any bids made by or on behalf of the defaulting Buyer at any future auctions or obtain a deposit before accepting any bids from the Buyer in the future.
28.10 purchased lots that remain uncollected may be disposed of or given to charity.

General Terms and Conditions for Buyers and Sellers

30.1 Philippa H Deeley Ltd acts as agents for the Seller (except where it is expressly stated to be selling as principal) and is not responsible for any default by the Seller or Buyer.
30.2 Philippa H Deeley Ltd has the right to refuse admission to its premises or attendance at its auction by any person. All persons are admitted to Philippa H Deeley Ltd’s premises to attend an auction on the basis that they have notice of these Conditions.
30.3 The copyright in all illustrations and written matter (including the Catalogue) relating to each Lot is the absolute property of Philippa H Deeley Ltd and no person may use or copy the same without the prior written consent of Philippa H Deeley Ltd. 30.4 Philippa H Ltd makes every effort to ensure that the Catalogue and description of the Lot are accurate but Philippa H Deeley Ltd makes no warranty to that effect.
30.5 All Statements whether made verbally or in the Catalogue are statements of opinion only and neither Philippa H Deeley Ltd or its employees or agents will be responsible for the accuracy of any opinion given. Each Lot is sold by the Seller with any and all errors of description, faults and imperfections.
30.6 Philippa H Deeley Ltd has the right to divide any Lot or combine two or more Lots, refuse any bid, withdraw any Lot from auction or (in the case of dispute) put any Lot up for auction again. The Auctioneer shall have the right to advance the bidding as he may decide.
30.7.1 – Philippa H Deeley Ltd shall be under no liability for any damage or loss sustained by any person while on Philippa H Deeley Ltd’s premises or while attending auctions conducted by Philippa H Deeley Ltd except for death or personal injury caused by the negligence of Philippa H Deeley Ltd, its employees and agents.
30.7.2 – Philippa H Deeley Ltd shall not be liable for any damage caused by the Seller or the Buyer to third parties or their property while on Philippa H DeeleyLtd’s premises or on any other premises from which Philippa H Deeley Ltd is conducting auctions. 30.8 - In the event of a sale after the auction of any Lot by private treaty the Seller and the Buyer agree to be bound by these Conditions and any agreed special conditions of sale.
30.9 - These Conditions shall be the only terms applicable to the sale of any Lot at an auction conducted by Philippa H Deeley Ltd
30.10 - Any notice by Philippa H Deeley Ltd to a Seller, prospective Seller, consignor, prospective bidder or Buyer may be delivered by hand, sent by first class mail or air mail or facsimile to the address last notified to Philippa H Deeley Ltd and shall be deemed to be received:
30.10.1 - if hand delivered, at the time of delivery;
30.10.2 - if sent by facsimile within 8 hours of transmission during business hours;
30.10.3 - if sent by mail within 48 hours of posting if posted to an address within the UK and 7 days of posting if posted to a country outside the UK;
30.11 - All transactions to which the Conditions shall apply shall be governed by English Law.
In the event of any dispute between Philippa H Deeley Ltd, the Seller and the Buyer concerning the sale of any Lot at an auction conducted by Philippa H Deeley Ltd, the matter shall be referred to a single independent arbitrator to be agreed upon by the parties in accordance with the Arbitration Act 1950 or any statutory modification if re-enactment of it for the time being in force.
